In 1988 they ruled that the Forest Service could cut timber on lands that had been used by Native Americans for religious purposes. In 1990 that ruled that two Native American drug counselors who had been dismissed for using peyote, a drug traditionally used in some Native American religious ceremonies, were not entitled to unemployment.
