As a consequence of the separation of state and federal governments in the U.S. system, court cases can arise under either federal law or state law. Most cases fall under the latter; over 95 percent of the nation's legal cases are decided in state or local courts. Cases that originate in state courts can be appealed to a federal court only if a federal issue is involved, which is usually not the case. When a federal court does become involved in a state case, it often confines itself to the federal aspects of the case, such as whether the defendant's constitutional rights were in fact violated.
