The 9th and 10th Amendments tend to be more vague and not as related to "negative rights” as the other previous eight are. The 9th Amendment was included to protect citi-zens’ access to rights not specifically listed in the Bill of Rights and not denied by law or through the Constitution. The 10th Amendment does the same for the states, which makes it the foundation of states’ rights arguments. Students should reinforce the link between the Ninth Amendment and a presumed right to privacy and the 10th Amend-ment with states’ rights issues.
