Explain the conflict of interest rule and create two scenarios wherein the attorney would have a conflict of interest
What will be an ideal response?
A conflict of interest is a situation where the interest of one client is directly adverse to the interest of another client; a student's response should contain this definition. Scenarios will vary, but some that would exist are the following: a husband and a wife in a divorce, both being represented by same attorney would present a conflict of interest; a patient who wants to sue a doctor for medical malpractice, both the patient and the doctor should not be represented by the same attorney. Student scenarios will be varied.
