These include the involvement of interest groups, awareness that lower court judges may ultimately have more influence than the Supreme Court because they hear so many cases, confirmation fights are seen as “warmups” for Supreme Court nomination fights down the road, polarization, and a desire to “wait out” a president late in his term in hopes that the next president will be of the opposite party.
