Why do segments that have an empty payload carry a sequence number? Why does this not result in confusion at the TCP receiver?

In TCP, each sequence number identifies a byte in the byte stream. Each datagram has a sequence number. This is used so that the other end can make sure that it gets the data in the right order, and that it hasn’t missed any. Without data, also it needs to get acknowledgement by sending sequence number. If the sequence number is not present, problems may arise when out-of-order or duplicated packets arrive. Adding a sequence number to empty TCP packets does not result in confusion because these TCP packets carry the sequence number of a last data octet being sent, these empty packet themselves do not contribute to the sequence number.
