Congress enacted the Equal Access to Justice Act to protect persons from harassment by federal administrative agencies. Under this act, a private party who is the subject of an unjustified federal administrative agency action can sue to recover attorneys' fees and other costs. The courts have generally held that the agency's conduct must be extremely outrageous before an award will be made under the act. A number of states have similar statutes.
