An annulment is an order of the court declaring that a marriage did not exist. The order invalidates the marriage. Annulments are rarely granted now that most states recognize no-fault divorces. Certain grounds must be asserted to obtain an annulment. Some of the grounds for annulment are that 1. one of the parties was a minor and had not obtained his or her parents' consent to marry, 2. one of the parties was mentally incapacitated at the time of marriage, 3 . one of the parties was intoxicated at the time of the marriage, or 4. the marriage was never consummated. Marriage can also be annulled if the parties are too closely related to one another or if there was bigamy. A marriage can also be annulled if there was duress or fraud leading to the marriage.
