(a) As championed by the United States and other nations outside the “global south,” it carries the stigma of colonialism and cultural hegemony. (b) The somewhat nebulous definition of the rule of law is crafted in large measure by a particular nation’s history, culture, politics, social norms, values, and the ongoing application of the law. (c) The law and the rule of law are products of people in a specific place and time, in response to particular needs and pressures. As such, there is a problem of “fit” that necessarily arises when it is transported outside its place of origin.
