Answer: The term contributory negligence deals with the fact that some driver's behaviors actually contributed to the accident and that these behaviors are not insured by the basic PAP. Things like speeding, driving too fast for conditions, running a red light, not wearing a seat belt or driving under the influence of drugs or alcohol contributed to the accident occurring. Since the driver was determined to be negligent in causing the wreck, then the Insurance company will reduce their payout accordingly.
