The process of mediation has its critics. They argue that the informal nature of the process represses and denies certain irreconcilable structural conflicts, such as the inherent strife between labor and management. They also argue that this informal process tends to create the impression of equality between the disputants when no such equality exists. The resultant compromise between the parties is an unequal compromise, but it is clothed in the appearance of equal influence.
The mediation process can also arguably be abused. A party who believes that he or she will ultimately lose a dispute may enter the mediation process in bad faith, dragging the process out as long as possible.
