What are the key protections of the First Amendment?

The First Amendment does not protect all forms of expression, despite its broad interpretation by many courts. Courts have found that certain forms of speech have the potential to lead to harm and thus do not get First Amendment protection. These categorical limitations include fighting words, threats, false advertising, and criminal solicitation. Courts have also noted that things like child pornography are exploitive and thus deserve no protection under the First Amendment. The initial inclusion of “the press” in the First Amendment covered most media formats available at the time. Newspapers still receive the broadest possible protection and broadcast journalism is governed through the Federal Communication Commission due to its use of the public airwaves. Other media forms, including satellite broadcasts and cable television, fall in between, as do certain forms of public relations and advertising. Current rulings place the Internet as being akin to newspapers in terms of protection.
