There are two types of due process: procedural and substantive. Procedural due process requires that a criminal whose life, liberty, or property would be taken by a conviction be given a fair trial; that is, he or she is entitled to notice of the alleged criminal action and the opportunity to confront his or her accusers before an impartial tribunal. Substantive due process refers to the basic fairness of laws that may deprive an individual of his or liberty or property. In other words, when a law is passed that will restrict individuals' liberty or their use of their property, the government must have a proper purpose for the restriction, or it violates substantive due process.
