There are four basic stages in a lawsuit. 1. Pretrial stage. The pretrial stage includes informal negotiations, pleadings, pretrial motions, discovery, and pretrial conference. 2. Trial. A trial begins with jury selection, which is followed by the opening statements, the plaintiff's case, the defendant's case, jury instructions, and closing arguments. 3 . Third are the post-trial motions, which may include a motion for a judgment notwithstanding the verdict or a motion for a new trial. 4. The final stage is the appellate stage, during which the party who lost at the trial appeals the case.
